JUDGMENT IN FAVOUR OF:
This inquiry by the Tribunal originated with a complaint lodged by Mr Narayan with the Anti-Discrimination Board on 3 December 1991. On 24 November 1992 the Board declined the complaint on the ground that it lacked substance. Mr Narayan, on 8 December 1992, pursuant to section 91 of the Anti-Discrimination Act 1977 (the Act), requested that the complaint be referred to the Tribunal. Subsequently Mr Narayan requested the Board to defer the referral for an interim period, as he had moved to Melbourne.
Following his move back to Sydney early in 1994, Mr Narayan requested the Board to refer the complaint to the Tribunal. On 21 September 1994, the Board referred the complaint to the Tribunal pursuant to section 94(1) of the Act. The hearing of the complaint commenced on 25 August 1995, and with spasmodic hearing dates, was concluded on 11 March 1996. Written submissions were made on behalf of the complainant and the respondent, the respondent's submission being received on 27 June 1996.
