1 The Respondent has applied for an order dismissing these proceedings under section 73(5)(g) of the Administrative Decisions Tribunal Act 1997 ("the ADT Act") on the following grounds: a, the proceedings are frivolous or vexatious or otherwise misconceived or lacking in substance within section 73(5)(g)(ii); b. the Applicant has failed to appear in the proceedings within section 73(5)(g)(iii); and c. there has been a want of prosecution of the proceedings within section 73(5)(g)(iv).
