DECISION [2003] NSWIRComm 231

1 This is an application by Novocastrian Wholesale Liquor Pty Ltd ('the company') seeking approval of an enterprise agreement between the company and the Warehouse Employees of the company ('the employees').

2 The application was subject to hearing on 18 July 2003. T Powell of T J Powell & Associates Pty Ltd appeared on behalf of the company with Mr R Johnson and Mr L Brennan. Mr S Grant, Mr S Hoppe and Mr R Steep appeared on behalf of the employees.

3 The application is supported by the necessary Statement of Particulars and an affidavit signed by Mr Rodney Johnson, in his capacity of Commercial Director, certifying that the agreement complies with all relevant statutory requirements, satisfies the no net detriment test, was not entered into under duress, and complies with the principles for approval of enterprise agreements as determined by the Commission.
