1 This is an application, pursuant to section 17 of the Industrial Relations Act 1996, ("the Act") by the NSW Independent Education Union ("the Union") for variation to the Teachers (Catholic Early Childhood Service Centres Pre Schools) (State) Award ("the Award"). 2 The Union initially filed an application under section 11 of the Act for a new award but subsequently amended its application to be a variation to the Award. 3 At the Hearing of the matter on 22 June 2005, Ms V Heron represented the Union and Ms Smith represented the Catholic Commission for Employment Relations. 4 The variation seeks improvements in rates of pay and conditions consistent with the State Wage Case Wage Fixing Principles: § 4% wage increase from the first full pay period on or after 1 July 2005; and § 2% wage increase from the first full pay period on or after 1 January 2006; § conversion of a maternity leave allowance into a maternity leave clause. 5 Having considered the application, the Commission is satisfied that the application should be granted. 6 The application shall take effect from 1 July 2005 and remain in force until 30 June 2006.
