DECISION
[2003] NSWIRComm 138
1 This is an application by Readymix Holdings Pty Limited ("the Company") seeking the making of a new award between the Company and the Australian Workers' Union, Newcastle and Northern NSW Branch (AWU), to cover employees at the Company's Newcastle site engaged as concrete workers.
2 The application was subject to hearing on 24 April 2003. Mr A Woods, solicitor of Fisher Cartwright Berriman, appeared on behalf of the Company. Mr P Sullivan appeared for the AWU.
3 Mr Woods tendered an amended application with revised award (Exhibit 1) which reflects a change in Company title post filing of the original application.
4 Mr Woods submitted that the award sought is to apply in conjunction with the Cement Mixers and Concrete Workers' Central Batch Plant (State) Award 321 IG 546.
5 Mr Woods submitted that the application is the result of extensive negotiations between the parties, conforms with legislative requirements and is consistent with the principles set down for the making of awards.
6 Mr Sullivan endorsed Mr Woods' submission and enunciated the consent of the AWU to the making of the Award in the terms of exhibit 1.
7 I am satisfied that the application meets all legislative requirements; that it conforms with the relevant State Wage Case principles; and that it is presented to the Commission with the genuine consent of the parties.
8 The Newcastle Concrete (State) Award 2002 is made in accordance with the application with effect from the first full pay period commencing on or after 24 April 2003 to remain in effect for a period of two years therefrom.
