DECISION

1 This is an application by Macquarie Generation for the making of a new award to replace the Macquarie Generation Employees (State) Award 1999 (317 IG 904) ('the 1999 Award').
2 The application is made with the consent of Macquarie Generation, the Labor Council of New South Wales and the following unions on behalf of the employees of Macquarie Generation:
- Electrical Trades Union of Australia, New South Wales Branch (ETU);
- Federated Municipal and Shire Council Employees' Union of Australia, New South Wales Division (MEU);
- Association of Professional Engineers, Scientists and Managers, Australia (New South Wales Branch) (APESMA);
- Construction, Forestry, Mining and Energy Union (New South Wales Branch) (CFMEU);
- Public Service Association of New South Wales (PSA);
- Australian Institute of Marine and Power Engineers New South Wales District (AIMPE);
- The Australian Workers' Union, New South Wales (AWU);
- Australian Manufacturing Workers' Union, New South Wales Branch AMWU); ('the Unions').
3 The application was subject to hearing on 16 December 2002 and again on 19 December 2002.
4 Mr K Petersen appeared on behalf of Macquarie Generation with Ms L Edmonds-Ward. Mr E Razborsek appeared on behalf of the Labor Council of New South Wales and respondent unions.
5 The application comes forward by consent of the parties following lengthy and detailed negotiations between them.
6 I am satisfied that the application meets all legislative requirements; that it conforms with the relevant State Wage Case principles; and that it is presented to the Commission with the genuine consent of the parties.
7 The Macquarie Generation Employees (State) Award 2002 is made in accordance with the application to apply from 11 December 2002 to remain in force until 30 June 2005.
