1 This is an application by Australian Industry Group (AIG) seeking variation of the Protech Steel Construction Kooragang Island Consent (State) Award 2001 334 IG 903 ("the award") made before the Commission as presently constituted on 12 December 2001.
2 The matter was subject to proceedings on 18 November 2002. Mrs E Morson appeared on behalf of the AIG. Mr E Razborsek appeared on behalf of the Labor Council of New South Wales and affiliated unions respondent to the award.
3 Mrs Morson tendered a revised Schedule A (Ex 1) setting out the variation sought by amendment of the operative date in Clause 3.1 of the award to 28 March 2006, which reflects the revised anticipated duration of the project.
4 Mrs Morson submitted that Exhibit 1 sets out a further variation to regulate wage rates and allowances for apprentices engaged on the project by insertion of a new subclause 6.9, Apprentices.
5 Mr Razborsek submitted that the variation sought is by consent of the parties and supported the application for variation.
6 I am satisfied that the variations sought in the terms of exhibit 1 meet all legislative requirements.
7 The Award is varied by consent in the terms of exhibit 1 with effect from 18 November 2002.
