DECISION

1 This is an application by OneSteel Wire Pty Ltd ('the Company') for variation of the OneSteel Wire Pty Ltd Newcastle Fence Post Plant Award ("the Award") (335 IG 1027) in respect to classification structure and corresponding rates of pay. The variation applies to Table 1 - Wages, of Part B, Monetary Rates of the Award.
2 The matter was subject to hearing on 4 July 2003. Mr R Cusick appeared on behalf of the company with Mr R Hooke and Mr M Wall. Mr K Maher appeared on behalf of the Australian Workers' Union, New South Wales, Newcastle & Northern Region Branch ("the union") with Mr D Williams and Mr S Gabriel.
3 Mr Cusick outlined a brief history of the company's operations and changes in the manufacturing process leading to the proposed new classification structure. Mr Cusick tendered (exhibit 1) a document detailing the new classification structure, together with proposed pay rates and bonus structure.
4 Mr Cusick submitted that the variation sought complies with current wage fixation principles.
5 Mr Maher enunciated the consent of the union to the variation sought in the terms of the application.
6 I am satisfied that the application for variation meets all legislative principles; and that it is presented to the Commission with the genuine consent of the parties.
7 The OneSteel Wire Pty Ltd Newcastle Fence Post Plant Award is varied in the terms of the application with effect from the first pay period on or after 18 June 2003.
