1 This Decision arises from a notice of review generated on 17 September 2007 by the Industrial Registrar, pursuant to s 19 of the Industrial Relations Act 1996 ("the Act").
The award to be reviewed is the Rural Lands Protection Boards Salaries And Conditions Award 2004 ("the Award"). 2 This file was set down for a Call Over on 26 November 2007. 3 Ms R Small appeared for the Public Service Association and Professional Officers Association Amalgamated Union of New South Wales.
Mr S Crawford appeared for the Australian Workers Union, New South Wales. 4 Mr M Boyd for the Rural Lands Protection Boards was unable to appear but despatched correspondence to the Commission advising that the Award had already been reviewed and rescinded by Cambridge C on 24 September 2007. The Award was replaced by the Rural Lands Protection Boards Salaries And Conditions Award 2007. (Serial C6253 - 5 November 2007). 5 Ms Small and Mr Crawford concurred with the content of Mr Boyd's correspondence and accordingly advised that this Award could not be rescinded as that process had already taken place by Cambridge C. 6 The Commission concurs with that observation.
