1 This Decision is issued further to the Extempore Determination made in this matter during proceedings held on 3 February 2006. 2 On 22 June 2005, the NSW Dental Assistants Association (the Union), made application to vary the Dental Assistants and Secretaries (State) Award, (the Award). 3 The application for variation to the Award was made pursuant to section 17 of the Industrial Relations Act 1996 (the Act). The application seeks variation to the Award to provide for wage rate and allowance increases in accordance with State Wage Case of June 2004 and 2005. 4 The matter was listed for consent hearing on 3 February 2006, at which time the following appearances were recorded: · Mr. Rudd – the Union · Mr. Tyrrell – Employers First and Australian Dental Association, NSW Branch. 5 Mr. Rudd advised that there was an agreement between the Parties to the Union's application to vary the said Award for the State Wage Case of June 2004 but not for the State Wage Case of 2005.
