1 This is an application pursuant to section 17 of the Industrial Relations Act 1996 ("the Act") filed on 18 September 2007 by the Director of Public Employment for variation of an award. 2 The matter was listed for Consent Hearing on 3 October 2007. Ms J Gordon, Employment Relations Advisor, appeared for the Director of Public Employment. Ms R Small, Industrial Officer, appeared for the Public Service Association and Professional Officers Association Amalgamated Union of New South Wales ("the Union"). 3 Ms Gordon spoke to the section 17 application which proposed to vary the Crown Employees (Public Sector Conditions of Employment) Reviewed Award 2006 ("the Award") for certain expenses, such as travel and meal allowances. She advised that the Award required that these certain allowances were to be adjusted on a periodic basis. 4 Ms Gordon also advised that a variation to certain provisions in the Award was necessary to correct typographical errors, update the Award for amendments to the Public Sector Employment and Management Act 2002 and to clarify any provisions which are currently ambiguous. 5 Ms Small consented to the application. 6 The Commission hereby confirms the Ex Tempore Determination made in this matter on 3 October 2007 and the Award is accordingly varied. 7 The variation to the certain allowances appearing in this s17 application are to have an operative date of 1 July 2007. Any other changes to the Award, arising out of this s17 application, are to have an operative date of 3 October 2007.
