Application by Director of Public Employment for a new Award
DECISION

1 This decision is issued further to the extempore approval for the Crown Employees Wages Staff (Rates of Pay) Award 2007 ("the Award"), which was provided during proceedings held on 22 June 2007.
2 On 18 June 2007, the Director of Public Employment made application for a new Award, pursuant to s 10 of the Industrial Relations Act 1996 ("the Act").
The application named nine other parties to the Award application.
3 The matter was set down for Consent Hearing on 22 June 2007. The Director of Public Employment was the Applicant in the proceedings and was represented by Ms K Leevers, Employment Relations Adviser.
All trade union Respondents (with one exception) were represented by the one Respondent: Unions NSW. Ms A Wilde appeared for all those Respondents.
The one exception was the Public Service Association and Professional Officers Association Amalgamated Union of New South Wales, which was represented by Ms R Small.
4 The application was supported by an Affidavit of Ms Leevers. The Affidavit advised that: the application was by consent and the application complies with ss 19(3), 19(4) and 23 of the Act.
5 Ms Wilde and Ms Small confirmed consent to the application.
6 The Award application provides for a 4% wage increase to apply from the first pay period to commence on or after 1 July 2007 to the Awards, Agreements and Determinations listed in Schedule A of the proposed Award.
The 4% wage increase is in accordance with the Memorandum of Understanding finalised on 2 September 2005.
7 Having considered the submissions of the parties and reviewing the document that has been filed, the Commission is satisfied that the Award should be made. The Award complies with the requirements of the Act and the Commission's Principles for Review of Awards and the Commission's State Wage Case Principles.
8 The Award is to rescind and replace the Crown Employees Wages Staff (Rates of Pay) Award 2005.
9 The Commission therefore approves the making of the Award and it shall take effect from 22 June 2007.
10 Accordingly, proceedings in this matter are concluded.
