HIS HONOUR:
1. This is a question of law raised in proceedings being heard by a commissioner and which has been referred to me under s 36(5) of the Land & Environment Court Act 1979 for determination. The question is as follows: Whether the development control plan Exhibit 3 in these proceedings is void and of no effect in that the plan was not made in accordance with the provisions of the Environmental Planning & Assessment Act 1979 and its Regulations.
