1 In this matter the parties seek the making of a new consent award. The hearing of this matter on 7 August was adjourned to permit the applicant, the Public Service Association and Professional Officers' Association Amalgamated Union of New South Wales, to file an affidavit dealing with the requirements of s 23 of the Industrial Relations Act 1996 ('the Act'). 2 A draft of the affidavit to be sworn by Mr John Cahill, the General Secretary of the Union was tendered at the hearing. I advised the parties that on the basis of that draft, it was my intention to make the new award, once the affidavit was sworn and filed. That has subsequently occurred. 3 Having regard to the terms of the proposed award, what was contained in Mr Cahill's supporting affidavit and the submissions of the parties, I am satisfied that the proposed new award complies with the requirements of the Act and of the applicable award making principles. It is accordingly appropriate that I exercise the Commission's discretion to make the new award in the terms which the parties have agreed. 4 For those reasons, I make the Independent Commission Against Corruption Award in terms of Exhibit 1. As required by the Commission's Rules, a copy of the new award has been provided by the applicant Union in computer readable format, for the settlement of the minutes of the new award. These proceedings are accordingly concluded. ------------------------
