JUDGMENT Introduction 1 This is an appeal against the refusal of Development Application No. 518/04 by Hornsby Shire Council (the council) for the subdivision of three existing lots into five lots at 25, 37 and 39 Belinda Crescent, North Epping (the site).
2 An inspection of the site and some adjoining properties was carried out on the morning of the first day of the hearing with representatives from both parties, local residents and Court appointed experts.
