JUDGMENT
1 COMMISSIONER: This is an appeal against the refusal by Woollahra Municipal Council (the council) of a development application (DA 793/2004/1) to demolish an existing two storey house and swimming pool and construct a four storey house with basement garage and swimming pool at 15-17 Fairfax Road, Bellevue Hill (the site). 2 For the reasons set out in this judgment I have concluded that the appeal should be dismissed and development consent refused.
