JUDGMENT 1 COMMISSIONER: This is an appeal against the refusal by Hornsby Shire Council (the council) of Development Application 1657/2004 for the subdivision of the land at 105 Oxley Dr., Mount Colah (the site) into two lots and the erection of a dwelling on one of the lots.
