JUDGMENT 1 This is an appeal under s 96(6) of the Environmental Planning and Assessment Act 1979 against the City of Sydney Council's refusal of a modification application to amend the consent granted by the Council to extend the hours of operation for the rooftop communal recreation area from 9pm to 12 midnight seven days per week. The relevant condition of consent 10A requires use of the rooftop kitchen and rooftop terrace to be between 7am and 9pm seven days a week.
