JUDGMENT 1 COMMISSIONER: This is an application pursuant to s 97(1) of the Environmental Planning and Assessment Act 1979 (the Act) against conditions of consent imposed by Auburn City Council (the council). The conditions were imposed as part of an approval of a s 82(A) review of determination for the demolition of existing structures and the construction of a two storey dwelling with attached single garage. The development application is DA-454/2008/A for lot 41 Sec 1 DP 12474, 46 Bombay Street, Lidcombe. Consent was granted on 24 November 2009.
