JUDGMENT 1 COMMISSIONER: This is an appeal against the refusal by Canada Bay City Council (the council) of an application to modify Development Application No 338/2004 (the original approval) under s 96(1A)(a) of the Environmental Planning and Assessment Act 1979 (EPA Act). The original approval provided for alterations and additions to an existing dwelling at 3 Tingara Lane, Cabarita (the site).
