The appellant was the owner of premises at 16 O'Connell Street, Sydney, and the respondent was the lessee of Level 7. In addition to rent, the lease required the respondent to pay the appellant 8.09% of the "additional outgoings", as defined in cl 23 of the lease. On 27 October 1997, the respondent exercised an option to renew its lease for a further term of three years commencing on 1 March 1998.
