JUDGMENT OF : Stein JA at 1; Santow JA at 6; Ipp JA at 43 DECISION : (1) Appeal upheld (2) Orders made by Payne DCJ set aside (3) Answer the question posed for determination under s 18B(2) of the Arbitration (Civil Actions) Act (being whether cl 51.1 of the contract had the effect that the Contractor must indemnify the State in respect of the State's forty per cent liability to the Plaintiff) in the negative (4) The State to pay the costs of the proceedings before Payne DCJ and the costs of the appeal.
