3351/01 HCK CHINA INVESTMENTS LTD v AACHEN (ASIA PACIFIC) CONSULTANTS LIMITED & ANOR JUDGMENT 1 MASTER: Both the plaintiff and the defendants have filed Notices of Motion pursuant to Part 10 and Part 11 respectively. The plaintiff's Notice of Motion seeks leave to proceed under Pt 10 r 2 and subsequently the entry of default judgment with damages to be assessed. The defendants' Notice of motion seeks an extension of time and orders under Pt 11 r 8(1)(g) and (h). In essence the defendants' seeks a permanent stay of the plaintiff's proceedings.
