JUDGMENT OF : Mason P at 1; Sheller JA at 2; Ipp JA at 42 DECISION : 1 Grant the claimant leave to appeal; 2 Appeal allowed; 3 Set aside the orders of Master Malpass of 29 October 2003 and in lieu thereof order; 1 Appeal allowed; 2 Set aside the order of the Consumer, Trader and Tenancy Tribunal of New South Wales of 19 December 2002 terminating the claimant's residential tenancy agreement and in lieu thereof order that the second opponent's application for termination of the tenancy and vacant possession of the premises be dismissed; 4 The second opponent to pay the claimant's costs of the hearing before Master Malpass and of the application for leave to appeal and of the appeal to this Court.
