JUDGMENT OF : Handley JA at 1; Hodgson JA at 55; Gzell J at 60 DECISION : 1. Appeal allowed with costs; 2. Set aside the judgment of the District Court in favour of the defendant; 3. In lieu thereof enter judgment for the appellant for $254,164.74 together with pre-judgment interest from 2 February 2001 until the judgment of this Court; 4. Appeal listed for mention before Handley JA at 9.30 am on 19 August 2003 for the entry of judgment for an amount which includes the pre-judgment interest unless in the meantime agreed short minutes have been lodged with the Registrar; 5. The respondent to pay the appellant's costs of the proceedings in the District Court; 6. The respondent to have a certificate under the Suitors' Fund Act 1951 in respect of the costs of the appeal if qualified.
