JUDGMENT OF : Sheller JA at 1; Tobias JA at 80; Einstein J at 81 DECISION : 1 Appeal allowed; 2 Set aside order 1 made by Acting Master Berecry on 30 August 2002 ; 3 In lieu thereof the defendant to pay the plaintiff the sum of $616,000 and upon payment, the defendant be declared the owner of all property presently registered in his name or possessed by him; 4 Confirm orders 2 and 3 made by Acting Master Berecry on 30 August 2002; 5 The respondent to pay the appellant's costs of the appeal but to have a certificate under the Suitors' Fund Act 1951; 6 The respondent's application for maintenance under s27 of the Act is remitted to the Equity Division for further consideration on the application of the respondent, if so advised.
