JUDGMENT OF : Meagher JA at 1; Tobias JA at 2; Foster AJA at 32 DECISION : a) Leave to appeal granted on condition that the claimants file their notice of appeal within 14 days of the date of these orders; b) Appeal allowed; c) The orders made by Acting Chief Judge Boyd-Boland on 30 April 2003 be set aside; d) Proceedings No. 8492 of 2002 in the District Court be dismissed; e) The opponent to pay the claimants' costs of the District Court proceedings and of the appeal but to have, in respect of the costs of the appeal, a certificate under the Suitor's Fund Act 1951, if entitled thereto.
