JUDGMENT OF : Mason P at 1; Sheller JA at 2; Beazley JA at 30 DECISION : 1 Appeal allowed; 2 Set aside orders 1 and 4 of Burchett AJ; 3 In addition to and in lieu of those orders, order as follows:; "1. That there be a verdict and judgment for the plaintiffs on the plaintiffs' Statement of Claim.; 3A. That the defendant pay to the plaintiffs the net proceeds of the harvest and sale of the sorghum crop in the sum of $177,982 together with interest on the sum invested during the proceedings in the sum of $12,013. This order to take effect from the date of payment of those proceeds together with interest thereon out of the trust account of Cole & Butler, Solicitors, to the defendant.; 4. That the defendant pay the plaintiffs' costs of the proceedings."; 4 The respondent to pay the appellants' costs of the appeal but to have a certificate under the Suitors' Fund Act 1951 if so qualified.
