JUDGMENT OF : Whealy J at 1 DECISION : The plaintiff is entitled to succeed on the claim under clause A1 of the Insurance Policy. He is accordingly entitled to a declaration on damages in respect of this claim. The plaintiff fails on the claim under clause 5A of the Policy because it is statute barred (s 14 of Limitation Act 1969). The Exhibits are to remain with the file.
