JUDGMENT OF : McColl JA at 1; Howie J at 2; Buddin J at 3 DECISION : 1 Leave to appeal against sentence imposed in respect of count 2 granted. 2 Appeal allowed (in part). 3 Confirm the head sentence but quash the non-parole period imposed in the District Court and in lieu thereof impose a non-parole period of 18 months which will expire on 27 January 2005 at which date the applicant will be eligible for release on parole.
