JUDGMENT OF : Wood CJ at CL at 1, 67; Smart AJ at 66 DECISION : 1. Grant leave to appeal; 2. Head sentence in relation to each count confirmed but non-parole periods quashed. In lieu thereof, specify non parole periods as follows; (a) Count 1: five years and four months to commence on 3 April 2002 and to expire on 2 August 2007; (b) Count 2: five years to commence on 3 April 2002 and expire on 2 April 2007; (c) Count 3: nine years and three months to commence on 3 April 2002 and to expire on 2 July 2011; 3. Specify 2 July 2011 as the earliest date on which the applicant would be eligible for release on parole.
