JUDGMENT OF : Wood CJ at CL at 1, 50; Barr J at 48; Hoeben J at 49 DECISION : 1. Leave to appeal granted; 2. Appeal allowed; 3. Sentence quashed, and in lieu thereof the Applicant is sentenced to a term of imprisonment of 9 years to commence on 12 October 2002, with a non parole period of 6 years and 3 months, to date from 12 October 2002, and to expire on 11 January 2009. The earliest date, therefore, on which the Applicant would be eligible for release on parole would be 11 January 2009.
