JUDGMENT OF : White J
DECISION : 1. Make orders in accordance with paras 1 and 2 of the amended summons; 2. Order that the cross-claim be dismissed; 3. Refuse the application for indemnity costs; 4. Order that the defendant pay the plaintiff's costs of the proceedings, including the cross-claim; 5. Exhibits may be returned after 28 days; 6. Reserve the matter for further consideration; 7. Grant liberty to either party to apply on 14 days' notice.
