DECISION: (By majority) (1) Refuse leave to rely on contention ground 1 and grant leave to rely on contention ground 2: dispense with filing of the notice of contention; (2) Appeal allowed; (3) Set aside orders 1 and 2 made by Campbell J on 22 April 2005 and the orders made on 31 March 2006, and in lieu thereof order that the question be answered no and that the first and second defendants pay the plaintiff's costs of the hearing of the separate question; (4) Remit the proceedings to the Equity Division for directions for their continuance; (5) Respondent pay appellant's costs of the appeal and have a certificate under the Suitors Fund Act if otherwise qualified.
