DECISION: (1) Appeal allowed; (2) Set aside the verdict, judgment and orders made by her Honour Judge English on 19 December 2003 and in lieu thereof order that there be a new trial on the issue of damages; (3) Order that the costs to date of the proceedings in the District Court be reserved to the judge hearing the new trial; (4) Order that the respondent pay the appellant's costs of the summons for leave to appeal and the appeal but to have a certificate under the Suitors' Fund Act 1951, if otherwise qualified.
