JUDGMENT: 1 HIS HONOUR: The Plaintiffs commenced this action by summons on 2 February 2005. They seek various forms of declaratory relief, damages and costs. They were successful in having the hearing expedited on the ground that the defendants alleged wrongful conduct, significantly impacts upon their capacity to earn income.
2 In the result, at the hearing before me I directed that the proceedings be confined to the application for declaratory relief. In the event that the Plaintiffs are successful and wish to pursue their claim for damages, a further hearing will be required to deal with that issue.
