CITATION : Re Katherine [2004] NSWSC 899 HEARING DATE(S) : 9-10 September 2004 JUDGMENT DATE : 29 September 2004 JURISDICTION: Common Law Division JUDGMENT OF : Studdert J DECISION : (1) Order that the interim orders made in the Children's Court on 2 July 2004 be set aside. (2) Order that the matter be remitted to the Children's Court to be heard and determined according to law by a magistrate other than the magistrate by whom the interim orders referred to in Order (1) were made. (3) Liberty to apply within forty-eight hours for any other orders appropriate to give effect to Orders (1) and (2) above. (4) Costs are reserved to afford the parties the opportunity to make appropriate submissions having considered this judgment, and the matter may be relisted for argument as to costs on a date to be arranged with my associate. My associate is to be approached for this purpose within seven days.
