JUDGMENT 1. On 19 October 2004 Ashington No 147 Pty Limited (the defendant) entered into a contract with Manufacturers House Pty Limited (the plaintiff) for the sale of Lot 48, 141-147A King Street, Sydney being Lot 48, Strata Plan 67212 and commercial premises, for $535,000.

2. The plaintiff claims: 1. A declaration that the purported notice of termination by the defendant of the contract dated 19 October 2004 for the sale and purchase of land ("Contract") situated at Lot 48, SP 6712 … ("Land") entered between the plaintiff and the defendant is of no effect.
