DECISION: (1) The appeal is upheld with costs (2) The orders of White J are set aside (3) The first respondent is ordered to pay the appellant $228,000.00. (4) The first respondent is ordered to pay J & J Superannuation Pty Ltd, the trustee of the appellant's superannuation fund, $87,163.00 (5) The first respondent to have a certificate under the Suitors' Fund Act 1951 (NSW) if otherwise qualified (6) The first respondent is ordered to pay the costs of the cross-appeal.
