DECISION : 1. Order that order 1 made on 12/12/05 by the Registrar be varied by extending the time for the provision of security from 10/2/06 to 5pm on 24/2/06; 2. Otherwise dismiss the plaintiff's notice of motion; 3. Order the plaintiff to pay the defendant's costs of the notice of motion; 4. Order that if the plaintiff fails to provide security in accordance with the orders made on 7/11/05 by 5pm on 24/2/06, the defendant have leave to have the costs of the notice of motion assessed forthwith.
