DECISION: Crown appeal upheld; Sentences passed and disqualification order made in the District Court on 10 August 2006, save for the matter then before the Court pursuant to a certificate as provided by s 166 of the Criminal Procedure Act 1986 (NSW) quashed; That the respondent be sentenced as follows; On each of counts 2, 3, 4 and 5: to a fixed term of imprisonment of 1 year and 3 months to commence on 10 August 2006 and to expire on 9 November 2007, all to be served concurrently; On count 1: to imprisonment for a non-parole period of 1 year 9 months to commence on 10 November 2007 and to expire on 9 August 2009, with a balance of term of 1 year 9 months to commence on 10 August 2009 and to expire on 9 May 2011; that the respondent be disqualified pursuant to s 188 of the Road Transport [General] Act 2005 (NSW) for a period of 4 years 9 months to commence on 10 August 2006 and to expire on 9 May 2011.
