(1) Allow the appeal and set aside the judgment and orders in the Common Law Division dismissing the Director's appeal from the decision of the Local Court. DECISION: (2) Set aside the order of the Magistrate in the Local Court made on 23 March 2007 dismissing the charge against the respondent laid under s 25A of the Road Transport (Driver Licensing) Act 1998. (3) Remit the matter to the Local Court to be dealt with according to law.
