(1) The appeal is dismissed. (2) Leave unders s 208M of the Legal Profession Act 1987 is refused. DECISION : (3) The three decision of the Costs Assessor dated 10 August 2004 referred to in para [12] of this judgment are affirmed. (4) The amended summons filed 16 November 2004 is dismissed. (5) The plaintiffs are to pay the defendant's costs as agreed or assessed.
