(1) The appeal is allowed. (2) The decision of Magistrate Pierce in Local Court proceedings numbered 41372/2006 dated 7 April 2008 is set aside. DECISION : (3) The Local Court proceedings numbered 41372/2006 are remitted to the Local Court to be determined according to law. (4) The defendant is to pay the plaintiff's costs of this appeal as agreed or assessed. (5) The defendant is to have a certificate under the Suitor's Fund Act, if appropriate. (6) The orders made in Local Court proceedings numbered 40833/2005 are affirmed.
