JUDGMENT OF: Hodgson JA at 1; Kirby J at 2; Whealy J at 127
DECISION: 1. The Crown appeal is allowed. 2. The sentence imposed upon the respondent is quashed and, in lieu thereof, he is sentenced to a period of 3 years imprisonment from 20 March 2010 until 19 March 2013, with a non parole period of 1 year 9 months to date from 20 March 2010 and expire on 19 December 2011, such term to be served by way of periodic detention. The respondent is to be released to parole on 19 December 2011.
