1. Leave to appeal against sentence granted. DECISION: 2. Sentence of imprisonment on the second count quashed and, in its place, the Applicant is sentenced to a non-parole period of 10 years commencing on 13 October 2008 and expiring on 12 October 2018 with a balance of term of three years and four months commencing on 13 October 2018 and expiring on 12 February 2022. 3. Appeal dismissed with respect to sentences imposed on Counts 1 and 3. 4. The earliest date upon which the Applicant will be eligible for release on parole remains 12 October 2018.
