(a) Appeal allowed. (b) Declare that the respondent is not entitled to recover from the appellants or retain from the proceeds of sale of the subject property the amount of $181,682.82 (or any interest thereon). DECISION: (c) Confirm the order for possession made by the primary judge on 13 March 2008. (d) The respondent to pay the appellants' costs of this appeal. (e) Remit the proceedings to Harrison J to hear and determine any applications as to costs at first instance that may be made to him.
