DECISION : I grant leave to the defendants to amend the cross-claim in terms of paragraphs 6(h)(iv) and 6(k)(vi), (vii) (viii), (ix) and (x) of the Second Further Amended Cross-Claim (MFI 18). I refuse leave to the defendants to adduce evidence on the matters that are the subject of paragraphs 54 to 122 of Alan Sobbi's affidavit sworn 12 November 2009.
