1. Appeal allowed. 2. The orders made by the primary Judge on 10 November 2009 be set aside. 3. In lieu thereof: DECISION: (a) judgment be entered for the Council; and (b) the respondent be ordered to pay the Council's costs of the proceedings. 4. The respondent pay the Council's costs of the appeal. 5. The respondent, if otherwise qualified, have a certificate under the Suitors Fund Act 1957.
