(2) Draft Notice of Appeal behind Tab 4 of the White Book should be treated as the Notice of Appeal. (3) Allow the appeal. (4) Respondent to pay costs of appeal. (5) Remit the case for trial in the Equity Division by a judge other than Gzell J. (6) Order that the respondent if eligible have a certificate under the Suitors Fund Act 1951 (7) That the orders made by Justice Gzell be set aside. (8) Costs in the first trial will be the subject of the order of the judge who conducts the second trial. [Note: The Uniform Civil Procedure Rules 2005 provide (Rule 36.11) that unless the Court otherwise orders, a judgment or order is taken to be entered when it is recorded in the Court's computerised court record system. Setting aside and variation of judgments or orders is dealt with by Rules 36.15, 36.16, 36.17 and 36.18.
